These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Merchant," "Agency," or "User"), and Lemah ("we," "our," or "us"), concerning your access to and use of the https://lema.app website, the SaaS platform, and all related automation services.
By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Services.
1. Description of Service
Lemah provides a cloud-based, multi-tenant social media chat automation and customer management workspace. The service functions through two distinct processing layers:
- Tier 1: Static processing engines running keyword matching and predefined routing responses.
- Tier 2: Generative AI ("AI Auto-Pilot") utilizing advanced large language models to orchestrate context-aware replies trained via the Merchant's custom Knowledge Lab data.
2. Licensing and Per-Channel Subscription Billing
Lemah operates on a recurring monthly usage license determined strictly by the number of active communication endpoints connected to the platform ("Channels").
- Subscription Selection: You agree to pay the standard recurring fee matching your selected tier (Solo Merchant, Growth Pro, or Agency Command) as displayed at the time of purchase.
- Dynamic Channel Scaling: Agencies and multi-tenant managers acknowledge that adding an additional social media node or store plug-in within the dashboard automatically adjusts their billing quantity.
- Cancellation and Refunds: You may disconnect channels or terminate your account balance at any point. Refunds are not provided for partial-month usages or unused channel licenses within an active billing loop.
3. Acceptable Use Policy
You are entirely responsible for the operations of your automated chat profiles. You explicitly agree not to utilize Lemah to:
- Violate Meta Platform Terms, Instagram Developer Policies, or WhatsApp Business Policies.
- Broadcast bulk unsolicited promotional messages ("Spam") or engage in harvesting user contact lists without explicit consent.
- Distribute, generate, or propagate deceptive, illicit, defamatory, or harmful communications.
- Attempt to reverse-engineer, exploit, or cause intentional system load latencies on our infrastructure.
We reserve the absolute right to instantly suspend or delete any channel license or master merchant account if your automation workflows trigger consecutive network rate-limits or are flagged by Meta Systems for platform abuse.
4. Artificial Intelligence & Operational Disclaimers
For users utilizing our Tier 2 AI Auto-Pilot functionality, you understand and acknowledge that generative artificial intelligence systems are probabilistic by nature.
- No Accuracy Guarantees: Lemah is a routing pipeline wrapper. We are not liable for AI "hallucinations," structural inaccuracies, or unintended conversational tone adjustments delivered to your end-customers.
- Human Oversight Recommendation: Merchants maintain ultimate responsibility for monitoring their AI agent behavior logs.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Lemah, its cloud operators, or developers be liable for any indirect, incidental, special, exemplary, or consequential damages (including loss of business revenue, customer churn, or brand reputational damage) arising out of the performance or failure of automated messaging processes.
6. Governing Law
These Terms and your use of the platform are governed by and construed in accordance with the laws governing digital commercial systems in the jurisdiction where Lemah operates its primary administrative infrastructure (Douala, Cameroon).
